Our Content
The Assess Plus platform, including its design, software, underlying code, and all assessments and content created by us, is owned by Assess Plus and our licensors and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal educational purposes in accordance with these Terms.
Your Content
You retain all ownership rights to the content you create and upload, such as your own test questions and teaching materials ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free license to host, store, reproduce, and display it solely for the purpose of providing and improving the Service for you.
Feedback
We welcome your suggestions and ideas. If you provide us with any feedback, you grant us an unlimited, irrevocable, perpetual license to use and incorporate that feedback into the Service without any obligation to you.
5. Privacy and Data Protection
We are committed to protecting your privacy and handling your data responsibly. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

TO THE FULLEST EXTENT PERMITTED BY LAW, ASSESS PLUS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM ITS USE WILL BE ACCURATE OR RELIABLE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASSESS PLUS, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO ASSESS PLUS IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).

You agree to indemnify and hold harmless Assess Plus and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

The Service may contain links to third-party websites or services. We do not control and are not responsible for the content or practices of these third-party sites. Your interactions with them are solely between you and the third party.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.
13. Changes to the Terms
We may modify these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
